Frequently asked questions

Answers to the most important questions for tax advisors

Your tax firm can outsource the entire transfer pricing cycle (i.e., the planning, restructuring, documentation, and defense of transfer prices) or specific individual steps to TPC. The range of services extends from the collection and structuring of intra-group business relationships, through functional and risk analyses, transfer pricing guidelines, and appropriateness analyses (such as database studies), to the preparation of the master file, local file, and transaction matrix.

We can also support ongoing implementation, for example, by reviewing intra-group agreements, adjusting transfer prices during restructuring, or monitoring existing transfer pricing models. This includes defending transfer prices in tax audits and providing support in objection, mutual agreement, and advance pricing negotiations. Further areas of expertise include the assessment of transfer pricing methods, intangible assets/intellectual property, goods deliveries, services, group allocations, and financing relationships (such as intra-group loans or cash pools).

A tax firm should seek specialized support in the area of transfer pricing as soon as a client has or develops cross-border business relationships between related companies. Transfer pricing is a highly specialized field that requires tax and business expertise as well as, typically, many years of practical experience.

Typical reasons for seeking transfer pricing support include the establishment or acquisition of foreign subsidiaries, new cross-border intra-group supply and service relationships, financing, licensing, cost allocations, functional relocations, or restructuring. Specialized support is also recommended if current transfer pricing documentation is unavailable or if a tax audit has been announced. Expert advice should also be sought early in the event of expansion, company sale, changes to the business model, or disputes with foreign tax authorities. This allows transfer pricing risks to be identified before they lead to financial and tax consequences or double taxation.

Yes, TPC supports lawyers, tax advisors, and their clients with transfer pricing issues during a tax audit. This includes, in particular, the analysis of audit findings, the preparation of robust lines of argumentation, the response to requests for information, and the preparation or review of statements and transfer pricing documentation.

If required, we also accompany discussions with the tax authorities and support the economic classification of complex issues, such as business transfers, financing relationships, or intra-group services. This collaboration can take place flexibly in the background or directly with the client and the tax authorities. The goal is a technically sound, documented, and practically implementable defense of transfer prices.

Client confidentiality is contractually guaranteed. TPC limits its activities to the agreed-upon scope of transfer pricing and respects the existing client relationship. Communication channels, direct client contact, and public image are agreed upon before the project begins. Upon request, we work exclusively as a subcontractor in the background. This allows the existing tax advisor to retain control and integrate specialized knowledge without having to build up their own permanent resources.

The communication model is tailored to the needs of the commissioning tax advisor. This can involve direct discussions with the client, including the tax advisor, or a completely indirect collaboration where TPC reports exclusively to the firm. At the start of the project, contact persons, deadlines, the data room, approvals, and the sender of work results are defined. The tax advisor remains informed about technical findings, risks, and next steps. This allows for efficient handling of queries and avoids conflicting statements to the client or tax authorities.

In a white-label collaboration, TPC provides the transfer pricing expertise behind the scenes. Reports, documentation, and analyses are provided by agreement without a TPC sender or in the corporate identity of the commissioning law firm. The law firm manages client communication, approvals, and billing. The scope of services, responsibilities, confidentiality, and quality control are agreed upon in advance. Upon request, TPC participates in expert meetings as a specialist for the law firm without assuming responsibility for the client engagement.

Depending on the project, fixed prices, hourly rates, modular packages, or ongoing support models are possible. The most suitable model is one that transparently outlines the scope of services and the risks associated with changes. A fixed price can be appropriate for clearly defined local files or benchmarking studies; for tax audits or open-ended design issues, a fee structure based on effort is often more suitable. For white-label projects, we can, upon request, assist the law firm with defining the scope of services and calculating costs for the client. Terms and conditions and additional expenses are documented before the project begins.

Specialized support can be beneficial even for initial cross-border transactions; a specific revenue or group size is not a prerequisite. Typical examples include foreign subsidiaries or branches, management fees, goods deliveries, licenses, loans, business transfers, documentation requirements, or tax audits.

The scope can be scaled from a short sparring session or review to full project management. The decisive factors are technical risk, complexity, and internal resource requirements – not just the transaction volume.

Before the project begins, the scope, work packages, data responsibility, review process, client communication, and approvals are defined in writing. The existing tax firm generally retains overall responsibility for the engagement; TPC is responsible for the agreed-upon specialized services within the scope of the contract. Interfaces with income tax, value-added tax, customs, legal departments, and foreign advisors are explicitly identified. A clear task matrix prevents duplication of effort and ensures transparent accountability for deadlines and technical assumptions.

Yes, your tax advisor can engage TPC specifically for individual transfer pricing services. A long-term partnership or the transfer of the entire transfer pricing process is not required. In practice, such individual requests often involve the preparation of database studies, functional and risk analyses and transfer pricing documentation, the review of intra-group contracts, questions related to intra-group financing, or support with specific issues during a tax audit.

The scope of services is tailored to your specific needs. For example, your tax advisor can handle the fact-finding and client communication, while TPC prepares the transfer pricing analysis or develops a tax-related line of argumentation. This is particularly useful when specialized knowledge is required at short notice, but building up your own transfer pricing resources is not economically viable.

Confidentiality, data protection, and client confidentiality are contractually regulated. Before accepting a project, it should be verified whether any actual or potential conflicts of interest exist. Access to documents is restricted to the project team, and communication and storage channels are coordinated. In white-label projects, it is also stipulated which information is disclosed to the client and who approves documents. This ensures that the collaboration remains transparent and reliable for both the law firm and the client.
